Terms & Conditions

1. Order Acceptance

Your order constitutes a request to purchase and does not form a binding contract until we send a formal order confirmation email (including order number, furniture details, total cost, and delivery address). We reserve the right to cancel orders and issue full refunds with prompt notification for the following reasons:
  • Stock Shortages: For non-custom furniture, we will notify you within 2 business days and refund the full amount (no fees or deductions). If a popular style (e.g., white sliding-door Wardrobe) is out of stock, we may offer a similar alternative with your consent.
  • Pricing Errors: If a product is listed at an incorrect price due to website glitches or data entry mistakes (e.g., £299 Storage Cabinet marked as £199), we will cancel the order and explain the discrepancy. We will not honor incorrect prices unless confirmed in writing by a store manager.
  • Incomplete Information: Orders with missing delivery details (e.g., no flat number, incorrect access notes for Wardrobe delivery) or incomplete customization data (e.g., no room dimensions for custom Tatami Mats) will be canceled if we do not receive updated information within 5 business days.
  • Suspected Fraud: Orders with unusual activity (e.g., multiple high-value Wardrobe orders to the same address, invalid payment cards) will be canceled to prevent fraud. You may reorder after providing proof of identity (e.g., copy of ID, utility bill).

2. Payment Terms

  • Accepted Methods: We accept the following secure payment options for UK orders:
    • Major credit/debit cards (Visa, Mastercard, American Express)
    • PayPal
    • Apple Pay
    • Klarna (buy now, pay later): Available for orders over £50 GBP, allowing split payments into 3 interest-free installments. Klarna’s approval is subject to their credit check, and their terms apply (including potential late fees for missed payments—see Klarna’s website for details).
  • Payment Security: All payments are processed via PCI DSS-compliant payment gateways. We never store full credit card numbers, CVV codes, or bank account details—financial data is encrypted and protected by SSL/TLS protocols.
  • Deposits for Custom Furniture: For made-to-order items (e.g., custom-sized Wardrobes, Tatami Mats cut to specific room dimensions), a 40% non-refundable deposit is required at order placement. This covers material sourcing and initial production costs. The remaining 60% is due 3 business days before delivery—we will send a payment reminder email with a secure link to complete the transaction. If the balance is not paid within 7 days, we reserve the right to cancel the order and retain the deposit.
  • Failed Payments: If a payment is declined (e.g., insufficient funds, expired card), we will notify you via email to update your payment details within 3 business days. For custom orders, failure to resolve payment issues within this period may result in production delays or order cancellation.

3. Product Descriptions & Variations

We strive to provide accurate, detailed descriptions of all furniture (including dimensions, materials, and finishes) on our website. However, minor variations may occur due to manufacturing processes or natural material properties—these do not constitute a breach of terms:
  • Size Variances: Due to wood expansion/contraction (for Wardrobes/Storage Cabinets) or straw compression (for Tatami Mats), finished product dimensions may vary by ±2cm (e.g., a 180cm wide Wardrobe may measure 178–182cm). This is within industry standards for large furniture and does not affect functionality.
  • Material Differences:
    • Wooden Furniture: Natural wood grain patterns, knots, or slight color variations (e.g., oak Wardrobes with lighter/darker streaks) are inherent to the material and enhance uniqueness—they are not defects.
    • Tatami Mats: Straw core density may vary slightly, leading to minor differences in firmness—this does not impact durability or comfort.
  • Finish Variations: Paint or veneer finishes (e.g., white Wardrobe doors) may have subtle sheen differences between batches due to drying conditions—these are not visible under normal lighting.
If a product differs significantly from its description (e.g., a “solid oak Storage Cabinet” made with particleboard, or a Tatami Mat with a thickness discrepancy exceeding ±1cm), you may return it under our Return & Exchange Policy for a full refund or replacement.

4. Shipping & Delivery

Shipping terms are governed by our separate Shipping Policy, which outlines destinations, costs, and timelines for large furniture. By placing an order, you agree to the following key provisions:
  • Delivery Access: You are responsible for ensuring the delivery location has adequate access for large items (e.g., 80cm minimum doorway width for Wardrobes, clear stairwells for multi-floor deliveries). If the courier cannot access the property (e.g., narrow hallways preventing Wardrobe entry), you will be charged a £49.99 re-delivery fee.
  • Delivery Sign-Off: Upon delivery, inspect the furniture for visible damage (e.g., cracked Wardrobe doors, torn Tatami Mat wrapping) and sign the delivery note to confirm receipt. Note any damage on the note—failure to do so may affect your ability to claim for defects later.
  • Risk Transfer: Risk of damage or loss passes to you upon delivery. We are not liable for damage occurring after delivery (e.g., Wardrobe scratches from moving it into the bedroom, Tatami Mat stains from improper handling).

5. Returns & Exchanges

Returns and exchanges are governed by our separate Return & Exchange Policy. By placing an order, you acknowledge the following additional terms:
  • Custom Furniture Returns: Custom items (e.g., Wardrobes cut to specific room dimensions) are only eligible for return if they have manufacturing defects. Changes of mind or incorrect size requests (due to customer-provided dimensions) are not accepted.
  • Return Condition: Furniture must be returned in its original packaging with all parts (screws, manuals, assembly tools) included. Missing parts may result in a 10–20% restocking fee (e.g., £20 for missing Wardrobe drawer handles).
  • Restocking Fees: For non-defective items returned due to change of mind, a 15% restocking fee applies (deducted from the refund) to cover repackaging and storage costs. This does not apply to defective or incorrectly shipped items.

6. Liability & Indemnity

  • Limitation of Liability: Our liability for any claim arising from your order (e.g., defective furniture, delivery delays, breach of terms) is limited to the purchase price of the affected item(s). We are not responsible for indirect, incidental, or consequential damages, including but not limited to:
    • Costs of alternative furniture rental due to delivery delays.
    • Damage to walls/floors during DIY assembly (e.g., drill holes from installing a Storage Cabinet).
    • Loss of use (e.g., inability to store clothes due to a defective Wardrobe).
  • Exceptions to Limitation: This limitation does not apply to liability for death or personal injury caused by our negligence (e.g., a Wardrobe tipping over due to faulty construction), fraud, or violation of mandatory UK laws (e.g., selling Tatami Mats with toxic materials).
  • Indemnity: You agree to indemnify and hold us harmless from any claims, damages, or costs (including legal fees) arising from:
    • Improper use or assembly of furniture (e.g., overloading a Storage Cabinet beyond its weight capacity, 50kg max).
    • Providing incorrect information (e.g., false room dimensions leading to an ill-fitting Wardrobe).
    • Unauthorized modifications to furniture (e.g., cutting a Tatami Mat to a smaller size).

7. Intellectual Property

  • All content on our website (including product images, 3D furniture renderings, assembly manuals, and design sketches) is our intellectual property or licensed to us by third parties (e.g., furniture designers, material suppliers). You may not copy, reproduce, or distribute this content without our written permission.
  • Custom furniture designs (e.g., unique Wardrobe configurations, Tatami Mat edge binding patterns) are protected by copyright. Unauthorized replication or sale of these designs is prohibited.

8. Data Privacy

We collect, use, and protect your personal information in compliance with the General Data Protection Regulation (GDPR) and the UK Data Protection Act 2018. Our Privacy Policy outlines how we handle data (e.g., delivery addresses, custom dimensions) and your rights to access or delete it. By placing an order, you consent to our data practices.

9. Changes to Terms & Conditions

  • We may revise these terms periodically to reflect:
    • Business updates (e.g., new delivery partners, expanded custom furniture options).
    • Legal changes (e.g., updates to UK furniture safety standards, GDPR amendments).
    • Industry practices (e.g., revised packaging requirements for Tatami Mats).
  • Updated terms will be posted on our website with a “Last Revised” date. Your continued use of our services (e.g., placing new orders) after this date constitutes acceptance of the revised terms.
  • For significant changes (e.g., increased deposit rates for custom furniture, new restocking fees), we will notify you via email at least 7 days before the changes take effect. You may cancel pending orders without penalty if you disagree with the new terms.

10. Governing Law & Dispute Resolution

  • These terms are governed by the laws of Scotland, United Kingdom (due to our Glasgow-based operations).
  • Any disputes arising from your order or these terms will first be resolved through informal negotiation. Contact us at dazzle-stews-3w@icloud.com to discuss the issue—we aim to reach a resolution within 10 business days.
  • If negotiation fails, disputes will be submitted to binding arbitration in Glasgow, conducted by the Scottish Arbitration Centre under their rules. The arbitrator’s decision will be final and enforceable in UK courts.
  • You waive the right to participate in class action lawsuits or collective disputes related to these terms.

11. Termination

  • We may terminate our services to you (e.g., refuse future orders, suspend account access) if:
    • You repeatedly violate these terms (e.g., returning non-eligible furniture multiple times, providing fraudulent payment details).
    • You fail to pay outstanding balances (e.g., custom furniture balance due).
    • You engage in abusive behavior toward our team (e.g., harassment via email or phone).
  • Termination will not affect existing rights or obligations (e.g., refund requests for defective items, payment of outstanding fees). We will notify you of termination via email, with a 7-day grace period to resolve any pending issues.

12. Miscellaneous

  • Entire Agreement: These terms, together with our Privacy Policy, Shipping Policy, and Return & Exchange Policy, constitute the full agreement between you and us. They replace all prior verbal or written communications about your furniture purchase.
  • Severability: If any provision of these terms is deemed invalid or unenforceable (e.g., by a court), the remaining provisions will still apply.
  • Waiver: Our failure to enforce any term (e.g., not charging a restocking fee for a late return) does not mean we waive the right to enforce it in the future.
